When someone is involved in an automobile accident where the person responsible for the accident is uninsured or under-insured, often the person injured has a claim against his or her own insurance company pursuant to the uninsured/under-insured motorist provisions contained in their policy. To hold their insurance company liable, they must have first purchased uninsured/under-insured motorist coverage.

Once it is determined that the person injured has such coverage and the person responsible for the accident is uninsured or under-insured, the relationship between the injured person and his/her insurance company becomes adversarial, and it is recommended that the injured person retain an attorney to assist them with that claim.
